Terms of Service

1. The Service

SEOTopSecret is an AI-powered growth operating system for organic search, content, AI visibility, and related marketing workflows. Features include content briefs, rank tracking, AI mention tracking, technical audits, schema generation, image generation, CMS publishing, and analytics integrations.

We may add, modify, or discontinue features over time. Material changes that remove or restrict a feature on a paid plan will be communicated in advance via email or in-app notice.

2. Accounts and eligibility

You must be at least 16 years old and capable of forming a binding contract to use the Service. One person or one legal entity may maintain one account per paid plan unless otherwise agreed in writing.

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly at hola@seotopsecret.com if you suspect unauthorized access.

3. Plans, fees, trials, and billing

Plans, included usage, and current prices are listed at seotopsecret.com/pricing. Fees are charged in advance on a monthly or annual basis via Stripe. All fees are exclusive of taxes unless stated otherwise.

Trials. Where offered, free trials convert to a paid subscription at the end of the trial period unless you cancel beforehand. You can cancel at any time from your workspace settings.

Refunds. Fees are non-refundable except where required by applicable consumer law. Annual plans are eligible for a pro-rata refund only within the first 14 days of the first annual term.

Price changes. We may change prices at any time. Changes apply on renewal and are notified at least 30 days in advance.

4. Acceptable use

You agree not to, and not to allow anyone to:

• Use the Service to violate law, infringe third-party rights, or produce unlawful, hateful, defamatory, sexually explicit, or deceptive content;
• Reverse engineer, scrape, or mirror the Service outside documented APIs;
• Resell or white-label the Service without a written agency agreement;
• Interfere with the Service, attempt to access other customers’ data, or probe for vulnerabilities outside a coordinated disclosure program;
• Use the Service to generate automated spam, black-hat link schemes, cloaking, or other tactics that violate major search engines’ guidelines;
• Upload malware, credentials, or data you do not have the right to process.

We may suspend or terminate the Service for a serious or repeated breach of this section after notice where feasible.

5. Your content and data

Ownership. You retain all rights in the content, data, and materials you submit to the Service (“Customer Content”). You grant SEOTopSecret a worldwide, non-exclusive license to host, process, transmit, display, and back up Customer Content solely to provide and improve the Service to you.

AI outputs. Briefs, drafts, images, and other outputs generated for you through the Service are yours to publish, modify, or remove as you see fit, subject to the acceptable-use policy above. You are responsible for reviewing AI-generated outputs before publishing them under your brand.

Processing role. When we process personal data contained in Customer Content, we act as your processor under our Data Processing Agreement (DPA). See the Privacy Policy for details.

6. Our intellectual property

The Service, including the software, interfaces, models, templates, methodology, prompts, documentation, and brand elements, is owned by SEOTopSecret and its licensors and is protected by copyright, trademark, and other laws. No rights are granted except as expressly stated in these Terms.

7. Third-party services and integrations

The Service integrates with third parties including Google (Search Console, Analytics, Drive), Stripe, Slack, Webflow, WordPress, and AI model providers. Your use of those services is governed by their own terms. SEOTopSecret is not responsible for the availability, accuracy, or practices of third-party services. We request the minimum scopes needed for the features you enable and you can disconnect integrations at any time.

8. Confidentiality

Each party will protect the other’s non-public information with the same care it uses for its own confidential information and at least reasonable care. Confidentiality does not apply to information that is public through no fault of the receiving party, independently developed, or required to be disclosed by law.

9. Availability and no outcome guarantee

SEOTopSecret provides the Service on a commercially reasonable best-effort basis. The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

SEO and AI visibility outcomes depend on factors outside our control, including search-engine and AI model behavior, your market, and your own editorial and technical decisions. We do not guarantee rankings, traffic, conversions, revenue, indexation timelines, or AI citation rates. We do not offer service-level credits, uptime refunds, or performance penalty clauses.

10. Limitation of liability

To the maximum extent permitted by law, SEOTopSecret and its affiliates will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of profits, revenue, data, or goodwill, arising out of or in connection with the Service, even if advised of the possibility.

Our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid to SEOTopSecret for the Service during the twelve months immediately preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You will defend, indemnify, and hold harmless SEOTopSecret from and against any third-party claim arising out of (a) Customer Content you submit to the Service, (b) your breach of these Terms, or (c) your use of AI-generated outputs that violate law or third-party rights after you published them.

12. Term and termination

These Terms apply for as long as you use the Service. You may cancel your subscription at any time from your workspace settings; cancellation takes effect at the end of the then- current billing period.

We may suspend or terminate the Service with notice for material breach of these Terms or of the acceptable-use policy, or immediately if required to protect the Service or other customers.

On termination, access to the Service ends and we will delete Customer Content within 30 days except where retention is required by law. You can export your data before termination using the Drive integration or the portal export tools.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email or in-app at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of Mexico, without regard to conflict-of-laws principles. Each party consents to the exclusive jurisdiction of the competent courts of Mexico City, Mexico, for any dispute arising out of or related to these Terms, subject to any mandatory consumer-law rights in your country of residence.

15. Miscellaneous

These Terms, together with our Privacy Policy, Cookie Policy, and any order form or DPA executed between the parties, constitute the entire agreement. If any provision is held unenforceable, the remaining provisions remain in effect. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
